You have probably heard the saying, “Penny wise and pound foolish.” Saving a few dollars now could result in thousands of dollars in legal fees later. Be careful with online forms! Most of these forms are drafted in other states and sometimes by people that are not attorneys. You need to know that every state has its own set of laws, many of which are not duplicated elsewhere. For example, if one were to find a purchase and sale agreement for real property online, it is very likely that form does not require a legal description for the property to be added. Washington is one of a handful of states that require a legal description in the purchase and sale agreement for the agreement to be valid. Our firm has seen individuals use online or boilerplate forms and we have had to give them the unfortunate news that the purchase agreement, though it was fully signed, is unenforceable.
